Terms and Conditions

1. About these Terms
1.1 These Terms and Conditions govern your access to and use of the TGM Collectibles website at www.tgmcollectibles.com.au, including purchases made through the website.
1.2 By accessing the website, creating an account or placing an order, you agree to these Terms and Conditions.
1.3 If you do not agree to these Terms and Conditions, you must not use the website or place an order.
1.4 These Terms should be read together with our:

• Returns and Refunds Policy
• Privacy Policy
• any product-specific conditions displayed on the relevant product page
If there is an inconsistency, mandatory rights under applicable law take priority.
2. Definitions
In these Terms:
• Australian Consumer Law means Schedule 2 to the Competition and Consumer Act 2010 (Cth).
• customer, you and your mean the person accessing the website or placing an order.
• order means a request to purchase one or more products from us.
• product means an item offered for sale through the website.
• website means www.tgmcollectibles.com.au.
• we, us and our mean any employee or representative of TGM Collectibles
3. Eligibility to purchase
3.1 You must be at least 18 years old to place an order, or place the order with the involvement and permission of a parent or legal guardian.
3.2 By placing an order, you confirm that:
• the information you provide is accurate and current;
• you are authorised to use the selected payment method; and
• you have read the product description and any important product notices.
3.3 Unless we agree otherwise in writing, purchases made through the website are retail purchases. Wholesale or commercial-volume orders may be subject to separate terms.
4. Product information
4.1 We take reasonable care to ensure that product descriptions, prices, images and other information are accurate.
4.2 Product images are provided for identification and illustration. Colours may appear differently depending on your screen, lighting and display settings.
4.3 Packaging may sometimes differ slightly from the images displayed because of manufacturing changes, regional packaging updates or supplier variations. We will not knowingly substitute a materially different product without contacting you.
4.4 Any material product variation will remain subject to your rights under the Australian Consumer Law.
Korean-language products
4.5 Products marked Korean are Korean-language products.
4.6 Korean products may differ from English, Japanese or other regional releases in areas including:
• packaging;
• printed language;
• pack or box configuration;
• card lists;
• promotional items;
• release dates; and
• product contents.
4.7 You are responsible for checking the language and stated contents before ordering. We will clearly identify the product language on the relevant product page.
Randomised and sealed products
4.8 Trading-card packs, booster boxes and other sealed products may contain randomised contents.
4.9 Unless a product listing expressly states otherwise, we do not guarantee:
• a particular card;
• a particular rarity;
• a particular pull rate;
• a minimum financial value;
• a grading result;
• future collectability; or
• resale or investment performance.
4.10 References to possible cards, rarities or set contents do not mean that a particular sealed product will contain those items.
4.11 Nothing in this section permits us to provide products that are incorrectly described, not genuine or otherwise fail to comply with applicable consumer guarantees.
5. Prices and taxes
5.1 All prices displayed on the website are in Australian dollars unless expressly stated otherwise.
5.2 Prices include GST where GST is legally applicable.
5.3 Shipping charges are additional unless the product page or checkout expressly states that shipping is included.
5.4 The total payable amount will be shown at checkout before you submit the order.
5.5 We may change product prices at any time before an order is accepted.
5.6 A price change will not affect an order that we have already accepted, except where the customer agrees to the change or where correction is otherwise permitted by law.
5.7 If a product is displayed with an obvious pricing or technical error, we may contact you before accepting the order. You may choose to proceed at the corrected price or cancel the affected item.
5.8 If we cannot accept an order because of an error, we will refund any amount already paid for the affected item.
6. Placing and accepting orders
6.1 Adding a product to your cart does not reserve that product.
6.2 When you submit an order, you are making an offer to purchase the products listed in that order.
6.3 An automated order acknowledgement confirms that we have received your order. It does not necessarily mean that the order has been accepted.
6.4 We accept an order when we send confirmation that it has been dispatched, or otherwise expressly confirm acceptance in writing.
6.5 We may reasonably decline or cancel an order before acceptance where:
• the product is unavailable;
• payment cannot be authorised;
• the order contains an obvious pricing or listing error;
• the delivery address is incomplete or outside our available shipping area;
• the requested quantity exceeds available or permitted limits;
• we reasonably suspect fraud, unauthorised payment or unlawful activity; or
• we cannot lawfully supply the product.
6.6 If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled products and any associated shipping charge that is no longer applicable.
6.7 We may limit quantities where reasonably necessary to manage scarce stock, prevent purchasing errors or provide fair access to limited products.
7. Payment
7.1 Available payment methods will be displayed at checkout.
7.2 Payments may be processed by third-party providers such as Wix Payments, PayPal or another enabled payment provider.
7.3 Your use of a third-party payment service may also be subject to that provider’s terms and privacy practices.
7.4 You must not use:
• a payment method without authorisation;
• false billing information;
• a fraudulent chargeback; or
• the website for unlawful financial activity.
7.5 If payment is reversed, declined or disputed, we may place the order on hold or cancel it, subject to applicable law.
8. Product availability
8.1 Product availability may change without notice.
8.2 A product appearing as In Stock does not guarantee availability until the order is accepted.
8.3 Where two customers order the final available item at approximately the same time, we may be unable to fulfil one of the orders.
8.4 If an ordered product becomes unavailable, we may:
• contact you about an appropriate alternative;
• remove the unavailable product and refund it; or
• cancel and refund the affected order.
8.5 We will not substitute a different product without your agreement.
9. Customer-requested cancellations
9.1 You may request cancellation by contacting us at support@tgmcollectibles.com.au.
9.2 We will try to process cancellation requests received before dispatch, but we cannot guarantee cancellation once packing or fulfilment has begun.
9.3 An order is not cancelled until we confirm the cancellation in writing.
9.4 If the order has already been dispatched, any return will be handled under our Returns and Refunds Policy and applicable law.
9.5 This section does not limit any cancellation right available under the Australian Consumer Law.
10. Preorders
10.1 This section applies only where we expressly offer a product as a preorder.
10.2 A preorder is an order for a product that is not yet ready for immediate dispatch.
10.3 Release dates and expected arrival dates are estimates based on information provided by manufacturers, distributors or suppliers. They may change.
10.4 We will communicate material delays where reasonably practicable.
10.5 Any special conditions concerning:
• preorder deposits;
• payment timing;
• cancellation;
• allocation;
• mixed orders containing preorder and in-stock products; or
• separate shipping charges
will be displayed before checkout or in the relevant preorder policy.
10.6 If we cannot supply a prepaid preorder, we will refund the amount paid for that product.
10.7 Nothing in this section limits rights available under the Australian Consumer Law.
11. Shipping and delivery
11.1 We currently deliver to eligible addresses within Australia, subject to the options displayed at checkout.
11.2 Shipping costs are calculated at checkout using the available delivery methods.
11.3 Tracked shipping is available Australia-wide where shown at checkout.
11.4 You must provide a complete and accurate delivery address.
11.5 We are not responsible for a delay or additional cost caused solely by an incorrect address supplied by you, although we will reasonably assist where possible.
11.6 Where a parcel is returned because of an incorrect address, failed delivery or refusal to collect, we may require payment of reasonable additional postage before resending it, unless the failure was caused by us or the carrier.
11.7 Dispatch and delivery timeframes are estimates unless we expressly agree otherwise.
11.8 We are not responsible for delays outside our reasonable control, but we will provide reasonable assistance and remain responsible for our obligations under applicable law.
11.9 Risk of loss or damage remains with us until the product is delivered to the nominated address, except to the extent that applicable law provides otherwise.
11.10 If you expressly authorise a carrier to leave a parcel unattended, delivery may occur in accordance with that authority. This does not remove any rights you may have where the parcel was not delivered as authorised.

12. Inspecting deliveries
12.1 Please inspect your order reasonably soon after delivery.
12.2 Contact us promptly if:
• an item is missing;
• the wrong product was supplied;
• the parcel or product arrived damaged;
• the product appears not to be genuine; or
• the product materially differs from its description.
12.3 You may be asked to provide reasonable evidence such as:
• photographs of the parcel;
• photographs of the shipping label;
• photographs or video of the product;
• the order number; and
• a description of the issue.
12.4 A request for evidence will not be used to unreasonably deny or delay a remedy.
12.5 Keep the product and packaging until we advise whether they are required for assessment or return.
13. Returns, refunds and consumer guarantees
13.1 Returns are governed by our Returns and Refunds Policy at Returns and Refunds.
13.2 Change-of-mind returns are available only to the extent stated in that policy.
13.3 A change-of-mind policy does not limit your rights where a product is faulty, unsafe, incorrectly described, not genuine or otherwise fails to comply with a consumer guarantee.
13.4 Our products come with guarantees that cannot be excluded under the Australian Consumer Law.
13.5 Depending on the nature of a failure, you may be entitled to a repair, replacement, refund, cancellation or compensation for reasonably foreseeable loss or damage.
13.6 We will not require you to deal only with the manufacturer or distributor where we have obligations as the seller.
13.7 Any return deadline applying to voluntary change-of-mind returns does not replace or shorten the period during which a consumer may be entitled to a remedy under the Australian Consumer Law.
13.8 Where applicable law entitles you to recover reasonable return costs for a faulty, damaged or incorrectly supplied product, we will arrange or reimburse those reasonable costs.
13.9 Refunds will ordinarily be issued to the original payment method unless another method is agreed or required.
14. Sealed products and returns
14.1 Restrictions on change-of-mind returns for opened or unsealed products may be set out in our Returns and Refunds Policy.
14.2 Opening a product does not remove rights that cannot legally be excluded.
14.3 We may decline a voluntary change-of-mind return where a sealed product has been opened, tampered with or is no longer in resaleable condition, provided this does not conflict with the Australian Consumer Law.
14.4 Dissatisfaction with randomised contents, pull results or resale value is not by itself evidence that the product is faulty or incorrectly described.
15. Customer accounts
15.1 You may be able to place an order as a guest or create a customer account.
15.2 You are responsible for:
• keeping your login credentials confidential;
• restricting access to your device and account;
• providing accurate account information; and
• notifying us of suspected unauthorised access.
15.3 You must not:
• impersonate another person;
• create an account using false information;
• attempt to access another customer’s account;
• interfere with the website’s security; or
• use automated systems to abuse stock limits or purchasing processes.
15.4 We may suspend or restrict an account where reasonably necessary to investigate suspected fraud, security risks or serious breaches of these Terms.
15.5 We will not suspend an account merely to avoid fulfilling an accepted order or providing a lawful remedy.
16. Wishlist and restock notifications
16.1 Wishlist and restock-notification features are provided for convenience.
16.2 Adding an item to a wishlist or requesting a restock notification:
• does not reserve the product;
• does not guarantee that it will return;
• does not fix the future price; and
• does not create an obligation for us to source the product.
16.3 Restocked products remain subject to availability.
17. Discount codes and promotions
17.1 Promotions may be subject to additional terms displayed with the offer.
17.2 Unless otherwise stated:
• discount codes cannot be exchanged for cash;
• only one discount code may be used per order;
• codes must be used before their expiry;
• excluded products remain excluded; and
• discounts cannot be applied retrospectively.
17.3 We may cancel or correct a promotion affected by a genuine technical or administrative error, provided customers who have already paid are treated fairly and in accordance with applicable law.
17.4 We will not use misleading former prices, false urgency or inaccurate discount claims.
18. Marketing communications
18.1 You may choose to subscribe to receive information about:
• new products;
• restocks;
• store updates;
• special offers; and
• other TGM Collectibles news.
18.2 Marketing consent is optional and is not required to place an order.
18.3 You may unsubscribe at any time using the unsubscribe link in a marketing email or by contacting us.
18.4 Transactional communications concerning an order, payment, delivery, account security or customer-service request may still be sent where necessary.
19. Reviews and customer content
19.1 If customer reviews or other submission features are enabled, you must only submit content that is honest, relevant and based on your genuine experience.
19.2 You must not submit content that:
• is false, misleading or fraudulent;
• infringes intellectual-property rights;
• includes private information about another person;
• is defamatory, threatening, discriminatory or unlawful;
• contains malware or spam; or
• relates to a product you have not genuinely used or purchased where verified-purchase status is claimed.
19.3 We may moderate or remove content that breaches these Terms.
19.4 We will not edit a negative review merely because it is critical of us.
20. Intellectual property
20.1 Unless otherwise stated, the website’s original text, layout, graphics, logo elements and branding owned by TGM Collectibles are protected by applicable intellectual-property laws.
20.2 You may access the website for personal shopping and informational use.
20.3 You must not, without permission:
• reproduce substantial website content;
• use our branding to imply affiliation;
• scrape product data for commercial use;
• copy original photographs; or
• create a misleadingly similar website or account.
20.4 Product names, packaging, character artwork and third-party trade marks remain the property of their respective owners.
20.5 TGM Collectibles is an independent retailer. We do not claim affiliation with or endorsement by Pokémon, Nintendo, Creatures, Game Freak or any other brand owner unless expressly stated.
21. Prohibited website use
You must not use the website:
• for unlawful or fraudulent purposes;
• to transmit harmful code;
• to interfere with website operation or security;
• to collect another person’s information without authority;
• to evade order limits;
• to make fraudulent payment disputes;
• to infringe another person’s rights; or
• to engage in conduct that could damage the website or other customers.
22. Third-party services and links
22.1 The website may use or link to third-party services including:
• payment processors;
• delivery carriers;
• order-tracking services;
• customer-account tools; and
• social-media platforms.
22.2 Those services may have their own terms and privacy practices.
22.3 We are not responsible for the independent content or operation of a third-party website that we do not control.
22.4 Nothing in this clause excludes responsibility that we have under applicable law for services used to fulfil your order.
23. Privacy
23.1 We handle personal information in accordance with our Privacy Policy at Privacy Policy.
23.2 Information may be provided to service providers where reasonably necessary to:
• process payments;
• fulfil and deliver orders;
• operate customer accounts;
• prevent fraud;
• provide customer support; or
• comply with legal obligations.
23.3 Do not provide payment-card information through ordinary email or a general contact form.
24. Website availability
24.1 We take reasonable steps to keep the website available and accurate.
24.2 The website may occasionally be unavailable because of:
• maintenance;
• technical failure;
• security work;
• third-party service disruption; or
• events outside our reasonable control.
24.3 We do not guarantee uninterrupted access to the website.
24.4 We will not use a website interruption to avoid obligations relating to an accepted order.
25. Liability
25.1 Nothing in these Terms excludes, restricts or modifies:
• the Australian Consumer Law;
• any consumer guarantee;
• liability for fraud or wilful misconduct; or
• any other right or liability that cannot legally be excluded.
25.2 To the maximum extent permitted by law, we are not responsible for loss caused solely by:
• your misuse of a product;
• your failure to follow supplied instructions or warnings;
• unauthorised access caused by your failure to protect account credentials;
• inaccurate information supplied by you; or
• an event outside our reasonable control.
25.3 We do not exclude liability for loss or damage that is reasonably foreseeable and caused by our failure to comply with a consumer guarantee.
25.4 Collectible products can change in market value. We are not responsible for fluctuations in resale value, collectability, grading results or secondary-market prices.
26. Changes to these Terms
26.1 We may update these Terms from time to time.
26.2 Updated Terms will be published on the website with a revised effective date.
26.3 Changes will generally apply prospectively.
26.4 Changes will not retrospectively remove rights relating to an order already accepted.
26.5 The Terms in effect when an order is accepted will ordinarily apply to that order, subject to any mandatory legal requirements.
27. Severability
If any part of these Terms is held to be invalid, unlawful or unenforceable, that part will be read down or removed to the minimum extent necessary. The remaining provisions will continue to operate.
28. No waiver
If we do not immediately enforce a right under these Terms, that does not mean we permanently waive that right.
29. Governing law
29.1 These Terms are governed by the laws of New South Wales, Australia, and applicable Commonwealth laws.
29.2 You and TGM Collectibles submit to the courts and tribunals having jurisdiction in New South Wales.
29.3 Nothing in this clause prevents a consumer from exercising a right to bring a claim in another jurisdiction where applicable law permits or requires it.
